Terms of use and sale

The short version: Kiritsu helps you keep your own rules. It never trades for you, it is not advice, and you can get your money back within 14 days.

Who you are dealing with

Kiritsu is made by [your name], trading as [business name], KVK [KVK number], [business address], the Netherlands ("we"). Contact: [support email]. Purchases are processed by our reseller, [payment provider], which is the merchant of record for your order and handles payment, tax and receipts.

Not financial advice

Kiritsu is a trading journal and discipline tool. It gives no trade signals, recommendations or advice, and it never opens a trade for you. Trading futures involves substantial risk of loss and is not suitable for everyone. Every trading decision, and its result, is yours. Limits, prop-firm rules and calculations in Kiritsu are aids: check them against your broker and your prop firm, whose rules change and always prevail.

Your orders

Kiritsu never places, changes, cancels or closes an order or a position. The Kiritsu add-on in NinjaTrader only reads your fills, stops and price bars. The stop window and the other prompts only inform you: whether you keep trading is your decision, and you remain responsible for every order and position on your accounts. Keep your broker's and prop firm's own loss limits set.

Kiritsu Free

You may install and use Kiritsu Free on your own computers at no cost, for as long as you like.

Kiritsu Premium

• Price. $49.99 a year if you subscribe before 1 January 2027, then $69.99 a year; or $10 a month. Prices include VAT where it applies. The price of your subscription will not go up for as long as you keep it active.
• Renewal. Premium renews automatically each year, or each month on the monthly plan, until you cancel. Your receipt email shows the renewal date.
• Cancelling. Cancel any time from the link in your receipt email or on the cancel and refund page. Premium then keeps working until the end of the year or month you paid for, and Kiritsu Free keeps working after it. After your first year, you can cancel at any time and get back the part of the year you have not used.
• Withdrawal and refunds. You may withdraw within 14 days of your first payment for a full refund, without giving a reason, using the withdraw from contract page or by email. This also covers your legal right of withdrawal as a consumer in the EU, and applies even though Premium starts working straight away.
• Your licence key. The key is for you. Use it on your own computers; you can move it to another computer from Settings. Do not share or resell it.

Your data

Your journal is stored on your computer, not with us; see the privacy policy. Kiritsu backs it up on every launch, but keeping copies of your data, for example with its export, is your responsibility.

Things you may not do

Do not copy, resell or redistribute Kiritsu, remove its licence checks, or use it to break the law or the rules of your broker or prop firm.

Updates and availability

We improve Kiritsu over time and may change, add or remove features. We will not remove a Premium feature you paid for during your current year without offering a pro-rata refund.

News and earnings dates

The news and earnings dates in Kiritsu come from public calendars run by others, which we do not control and which can be late, incomplete or wrong. Check important times with an official source. You can turn the downloads off in Settings.

Liability

Kiritsu is provided as it is. We do our best to make it accurate and reliable, but we cannot promise it is free of errors. To the extent the law allows, we are not liable for trading losses, missed trades, lost profits, lost or closed prop-firm accounts, or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to damage caused by our intent or gross negligence, or to liability that cannot be limited by law (for example for death or personal injury, or under product liability law). Nothing in these terms limits rights you have as a consumer that the law does not allow to be limited.

Law

These terms are governed by Dutch law. If you are a consumer, you also keep the protection of the laws of the country you live in, and you may go to the courts there.

Changes to these terms

If these terms change, the new version is posted here with a new date. Changes that matter for Premium apply from your next renewal, and you can cancel before then.
